MEMBERSHIP PROCEDURES

The rules and processes related to ITS Türkiye membership are determined by the ITS Türkiye Charter in accordance with existing laws and regulations, as well as the Procedures and Principles related to ITS Türkiye Membership and Payments, which were adopted and entered into force at the General Assembly. The membership types are as follows:

1-      Potential Member

hey are real or legal persons who satisfy have the conditions to become a member of the Association but have not yet applied.

2-      ITS Volunteer

Real persons who are not in a position to undertake financial obligations, but those who would like to be informed about the activities of the association before becoming a member, or those who cannot or do not want to be a member of the association for various reasons, can become ITS Volunteers of ITS Türkiye. Legal entities (companies, NGOs, universities, public institutions, etc.) who would like to be an ITS Volunteer can be ITS Volunteers being represented by a real person (individual person) that they will designate. ITS Volunteers do not pay dues under any name, they cannot have the right to elect and be elected, but they can be informed about the works of the association and can participate to them.

3-     Candidate Member

They are real or legal persons who have applied for membership but have not yet been accepted to membership by the Board of Directors.

4-     Member

They are real or legal persons whose membership application has been accepted by the Board of Directors and membership decision has been processed in the Member Registry.

5-    Hononary Member

They are real people whose experience and visionary in the sector the association can benefit from and those contribute to the association with their ideas and suggestions.
 
PERSONAL MEMBERSHIP 

The persons who would like to apply individually to ITS Türkiye must be Turkish citizens or if they are foreign citizens, they must have the right to settle in Türkiye in accordance with the provision of Article 93 of the Turkish Civil Code No. 4721. They must not have a commercial activity in any of the areas related to ITS, but they must have an interest in ITS. Natural persons working in a commercial firm or institution and an organization operating in any of the areas related to ITS can apply for membership.

For membership application, the Real Person Member Application Form must be filled and delivered to our association together with the attached documents. The reference letter included in the annexes must be obtained from at least 3 (three) members of the association, at least one of which is should be among the members of the Board of Directors.

LEGAL ENTITY MEMBERSHIP

Companies wishing to apply to ITS Türkiye as a legal entity must be established in accordance with the Turkish Commercial Code and have activities in any of the fields related to ITS; otherwise, its membership will not be accepted as per the laws and ITS Türkiye Regulations. Commercial companies of foreign origin that open offices in Türkiye cannot become members.

The first step to be taken is to take a decision by the competent decision-making authority on the legal entity's membership in associations. This authority can be the Board of Directors of a legal entity or its authorized official. After this decision, the membership application is completed by delivering the documents given below to our association and the candidate member status is obtained.

MEMBERSHIP OF PUBLIC ORGANIZATIONS

Public institutions and organizations that do not have legal barriers to become a member of associations, especially municipalities, may apply for membership together with the decision taken by their authorized bodies or authorities. In the signed decision document, it should be clearly indicated who the institutions will be represented by.

NON-GOVERNMENTAL ORGANIZATIONS

Non-governmental organizations can also become members of ITS Türkiye. Non-governmental organizations wishing to become a member should take the decision of the Board of Directors (BoD) if it is authorized to approve the membership of an association in the bylaws. If BoD is not authorized, then the decision of the general assembly is required. Together with the decision taken, they will make their applications with a petition in which the name of the authorized person to represent their legal entities is clearly indicated.

COMPLETION OF THE MEMBERSHIP PROCESS

Individuals or legal entities who have contacted ITS Türkiye with their complete application forms gain the status of a Candidate Member. Gaining candidate member status does not mean gaining any rights.

If necessary, the Board of Directors of ITS Türkiye conducts an examination of the candidate. The application will be discussed at the upcoming ITS Türkiye Board of Directors meeting to be held. The Candidate Member is also invited to this meeting and is asked to make a short but satisfying presentation about themselves and especially about their work in the field of ITS. As a result of the evaluations, a decision is made about the acceptance of the Candidate Member for membership or the rejection of the application, and it is communicated to the candidate member in written format. Admission to membership takes place with the absolute majority of the number of members of the Board of Directors.

If the decision is positive, the Candidate Member gains the title of Member and it is recorded in the Member Registry. Candidate Members whose membership application have not been accepted may object to the result at the first General Assembly if they wish. The decision of the General Assembly is final and the result can be challenged by filing a lawsuit in Ankara Courts. Membership is not a certainty until the judicial process is over.

 
ENDING MEMBERSHIP and WITHDRAWAL

Ending the membership of ITS Türkiye can be carried out in two ways:

1-    By the member's own request
2-    Termination of membership by the Decision of the Board of Directors

The person members who would like to resign from the membership of the association can leave at any time by applying with a petition. Legal persons, on the other hand, are required to take a decision to leave the association within the decision-making mechanism by following the same method applied when entering the association membership.

Membership of the Association shall be terminated in case of non-payment of the annual dues or, if any, the committed payments. In the event that one of the situations specified in Article 13 of the Association's statute occurs, dismissal from membership may be carried out by the decision of the Board of Directors of the Association.

In case of resignation or dismissal from membership by the decision of the Board of Directors, the following issues must be fulfilled:

Payment of membership fees and commitments if any will be made. In case of resignation or dismissal from membership by the decision of the Board of Directors, no refund is made from the membership fee paid by the member for that year with a prorated account.

Return of valuable documents and belongings, if any.

Elimination of issues, if any, that may impair the proper functioning of the association.

 
CHANGE OF REPRESENTATIVE FOR LEGAL ENTITY MEMBERS

Our legal entity members who would like to change their representatives can change them with the decision to be taken by their authorized bodies. In the decision to be taken, the name and surname of the new representative should be included along with the Identity Number. After this decision is taken, it is required to submit the Petition for the Change of Representative and its annexes to our association. After the application is received by our association, the change of representative will become legal with the decision of the Board of Directors. Verbal applications or requests for representative changes to be notified by unauthorized persons cannot be taken into account.
